TERMS AND CONDITIONS
1. Definitions
Client: The individual or entity requesting web design services.
Designer: Harvey's Web Design, the provider of web design, hosting, and maintenance services.
Project: The website design and development work as described in the agreed project proposal.
2. Acceptance of Terms
By engaging the Designer for web design services, the Client agrees to the following terms and conditions.
3. Project Initiation
3.1. A detailed project proposal, including scope, timeline, and deliverables, will be provided to the Client.
3.2. A non-refundable deposit of 33% of the total project cost is required to commence work.
3.3. The remaining balance is due upon completion of the Project and before the final delivery or launch of the website.
4. Payment Terms
4.1. The Client agrees to pay the Designer as per the payment schedule:
33% deposit upon agreement of project details.
67% balance upon completion of the Project.
4.2. Payment for hosting and maintenance services is to be made monthly in advance.
4.3. All invoices are payable within 14 days of receipt. Late payments may incur a late fee of 5% per month.
5. Project Timeline
5.1. The Designer will make every effort to meet the agreed timeline. However, delays caused by the Client, such as late approvals or content submission, may impact the delivery schedule.
5.2. Any significant changes or additional requests beyond the initial project scope will require a new agreement and may affect the timeline and cost.
6. Revisions
6.1. The project includes up to [number] rounds of revisions. Additional revisions will be charged at an hourly rate of [rate].
6.2. Revisions must be requested within 14 days of the initial delivery. After this period, further changes will be considered new work.
7. Hosting and Maintenance
7.1. The Designer offers hosting and maintenance services at a monthly fee, detailed in the hosting agreement.
7.2. The Client agrees to pay the monthly fee in advance. Non-payment may result in suspension of hosting services.
7.3. Maintenance includes updates to the website's core systems and minor content changes as per the maintenance package.
8. Ownership and Rights
8.1. The Designer retains ownership of all design and development work until full payment is received.
8.2. Upon full payment, the Client will receive ownership of the website's front-end code and design. The Designer retains the right to showcase the Project in their portfolio.
9. Post-Completion Support and Liability
9.1. The Designer is not responsible for future updates or compatibility issues arising from new browser versions, technologies, or third-party integrations unless covered under an active maintenance agreement.
9.2. The Client is responsible for ensuring the website remains compatible with evolving technologies by subscribing to the Designer’s maintenance services or managing updates independently.
9.3. The Designer is not liable for any damages, including lost profits or data, arising from the use or inability to use the website after the Project's completion.
10. Cancellation and Refunds
10.1. The Client may cancel the Project at any time. However, the 33% deposit is non-refundable.
10.2. If the Project is cancelled after additional payments have been made, a refund will be issued at the Designer's discretion, based on the work completed.
11. Liability
11.1. The Designer is not liable for any damages, including lost profits or data, arising from the use of the website.
11.2. The Client is responsible for ensuring the legality and accuracy of all content provided.
12. Governing Law
These terms and conditions are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
13. Amendments
The Designer reserves the right to update these terms and conditions at any time. The Client will be notified of any changes.
By engaging the Designer's services, the Client acknowledges that they have read, understood, and agreed to these terms and conditions.
